Terms of Service

These terms govern the use of WhizWiz, a messaging, calling, and meetings application made by WhizWiz Technologies, part of Scriptechn, Jordan ("WhizWiz Technologies", "we", "us"). By using WhizWiz you agree to these terms. If you use WhizWiz through an organization, that organization's own rules also apply to you, and where they are stricter, they take precedence.

How WhizWiz is provided

WhizWiz is deployed separately for each organization under an agreement between that organization and WhizWiz Technologies. The organization operates its deployment, or contracts us to host and operate it, and administers the accounts on it. Your access to WhizWiz comes from your organization and can be changed or ended by it.

Accounts and devices

• Your account is created by your organization's administrator and may be used only by you.
• You are responsible for the security of the devices you link to your account and for locking the app where your organization requires it.
• Your organization may require each device to be approved before it can be used, and may remove a device or an account at any time.
• You must tell your organization promptly if a device with WhizWiz on it is lost, stolen, or compromised.

Acceptable use

You may use WhizWiz only for lawful purposes and in line with your organization's policies. You must not:

• Send content that is illegal, threatening, harassing, defamatory, or that infringes another person's rights.
• Attempt to access accounts, conversations, devices, or servers you are not authorized to access.
• Interfere with the operation of a deployment, probe it for weaknesses without written permission, or overload it.
• Reverse engineer, decompile, or modify the software except where the law expressly allows it.
• Use bots, the AI assistant, or any integration to collect data from a deployment beyond what your organization has authorized.
• Record a call or meeting in a way that breaks the law that applies to you or to the other participants.

Your organization's administrator can suspend or remove accounts that break these rules. Where the law requires it, we may cooperate with lawful requests from authorities.

Content

You keep ownership of the messages, files, and recordings you create. Your organization's agreement with us and its own policies determine how that content is stored, retained, audited, and deleted on its deployment. Messages are end-to-end encrypted unless your organization has configured client-server encryption for auditing; see the Privacy Policy for details.

Availability

We work to keep WhizWiz available and reliable, but we do not promise that it will be free of interruptions or errors. Maintenance, updates, network conditions, and the infrastructure operated by your organization all affect availability. Service levels, where agreed, are set out in the organization's agreement with us and not in these terms.

Some features depend on third parties, such as app stores, push notification services, and the AI provider your organization selects. We are not responsible for the availability of those services.

Intellectual property

WhizWiz, including its software, design, documentation, and trademarks, belongs to WhizWiz Technologies and its licensors. Your organization's agreement grants it a license to use the software for its deployment; nothing in these terms transfers ownership to you or to your organization. Where a deployment is branded with an organization's name and identity, that branding remains the organization's property.

Updates

We release updates to the software to add features, fix faults, and maintain security. Some updates are delivered through the app stores and some directly to the app. Your organization may require you to run a minimum version, and older versions may stop working with a deployment after an update.

Termination

Your organization may end your access at any time, for example when you leave it. We may suspend or end access to a deployment if the organization's agreement with us ends or if use of the software materially breaks these terms. On termination your devices are signed out, and content is handled according to the organization's retention policy and the Privacy Policy.

Liability

WhizWiz is provided as is. To the extent permitted by law, WhizWiz Technologies is not liable for indirect, incidental, or consequential loss, for loss of data caused by devices, networks, or infrastructure we do not operate, or for content sent by users. Where liability cannot be excluded, it is limited to the amount paid to us by your organization for the service in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability for fraud or for anything that cannot be limited by law.

Governing law

These terms are governed by the laws of the Hashemite Kingdom of Jordan. Disputes that cannot be resolved by agreement are subject to the exclusive jurisdiction of the courts of Amman, Jordan, unless the agreement between your organization and WhizWiz Technologies provides otherwise.

Changes to these terms

We may update these terms from time to time. The date at the top shows the latest revision. Significant changes will be announced in the app or on this site before they take effect. Continued use of WhizWiz after a change means you accept the updated terms.
